1. Service description

OminiGate ("the Service") is a unified API gateway that forwards requests to upstream AI model providers and bills usage on a pay-per-token or pay-per-call basis. The Service is operated by OminiGate and accessed via https://api.ominigate.ai.

2. Eligibility and accounts

  • You must be at least 18 years old to use the Service.
  • You must provide accurate registration information and keep it up to date.
  • You are responsible for all activity under your account, including the safe storage of API keys.
  • One person or legal entity should maintain a single account; duplicate accounts created to abuse promotions or evade limits may be suspended.

3. Acceptable use

  • You may not use the Service to generate content that is illegal under applicable law, that infringes third-party rights, or that violates the policies of upstream providers.
  • You may not use Service outputs to train or fine-tune models that compete with OminiGate or upstream providers, mirroring restrictions in upstream provider terms.
  • You may not attempt to circumvent rate limits, balance enforcement, or abuse detection mechanisms.
  • You may not resell raw model access without a separate written agreement.

4. Billing and credits

  • The Service is prepaid: you top up credits via Stripe, and consumption deducts from your balance in real time.
  • Pricing is published on the pricing page and on each model's detail page. Prices may be updated; future requests will use the then-current price.
  • Credits already consumed for delivered API responses are non-refundable. Unused credits may be eligible for refund at our discretion; contact support to request a refund.
  • If your balance reaches zero, the Service returns HTTP 402 and your API keys remain active for use after top-up.

5. Service availability

We operate the Service on a best-effort basis with redundant infrastructure and multi-provider failover where available. We do not guarantee uninterrupted or error-free operation. Specific service level commitments, when offered, are documented in a separate enterprise agreement.

6. AI output disclaimers

AI-generated outputs may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for reviewing outputs before relying on or publishing them. The Service is not provided for use in high-risk settings (medical, legal, life-safety) without independent review by qualified professionals.

7. Termination

You may close your account at any time by contacting support. We may suspend or terminate accounts that violate these terms, abuse the Service, or pose a risk to other users. On termination, unused credits may be forfeit if termination resulted from a violation of these terms.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability under these terms is limited to the amount you paid to OminiGate in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or punitive damages.

10. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state and federal courts located in Delaware.

11. Changes to these terms

We may update these terms from time to time. Material changes will be announced on this page and the Last updated date will be revised. Continued use of the Service after an update constitutes acceptance of the revised terms.
